1. Introduction & Acceptance

These Terms of Service ("Terms") govern your access to and use of LEMOON, including our mobile apps, website, creator tools, and any other features or services provided by LEMOON SAS ("LEMOON", "we", "us", "our").

By creating an Account or using LEMOON in any way, you agree to be bound by these Terms and our Content & Community Guidelines, and you acknowledge our Privacy Policy.

If you participate in a monetization program, the Creator Monetization Terms and any applicable Program-specific terms will also apply.

If you do not agree to these Terms, you must not use LEMOON.

2. Definitions

LEMOON : The mobile app, website, creator tools, and all related services operated by LEMOON SAS.

Account : A personal LEMOON account used to access and interact with the Services.

User : Any individual who creates an Account on LEMOON, whether as a Reader, Creator, or both.

Creator : A User who publishes Creator Content on LEMOON.

Reader : A User who reads comics or interacts with Content on LEMOON.

User Profile : A public or private profile page generated from a User Account. Both Readers and Creators may update their profile information and choose what is displayed.

Content : Any material made available through LEMOON, including comics, episodes, artwork, images, text, profiles, comments, and other materials.

Virtual Items : Digital items or credits made available for use within the Services, including Lemoon Coins. Virtual Items have only the functionality made available by LEMOON and are subject to these Terms and any conditions displayed when they are obtained or used.

Paid Content : Content or features for which LEMOON requires payment, Virtual Items, or another access method made available through the Services.

Services : The LEMOON website, mobile applications, creator tools, community features, digital content features, and other functionality made available by LEMOON.

User Content : Any Content submitted, uploaded, published, or otherwise made available by a User.

Programs : Optional LEMOON programs that may be subject to separate terms, including creator monetization programs.

3. Account Creation & Eligibility

To access certain features of LEMOON, such as saving your favorite series, commenting, publishing comics, or accessing certain paid features, you need to create an Account.

3.1 Eligibility

To use LEMOON, you must meet the age requirements below:

  • Minimum age:

    LEMOON is not intended for children under 13, if you are under this age, you may not create an Account or use the Services.

  • International users:

    If your country sets a higher minimum age for digital consent, you must meet the applicable age requirement.

We may require age confirmation or verification when necessary to comply with applicable laws or protect our community.

3.2 Account information

When creating an Account, you agree to:

  • provide accurate and truthful information,
  • keep your login credentials secure,
  • not share your Account with others,
  • notify us immediately of any unauthorized access

LEMOON is not responsible for losses caused by unauthorized use of your Account. You may be held responsible for losses caused to LEMOON or others if your Account is misused.

3.3 Login methods

You may access your Account using the login methods made available through the Services.

Some features may require verifying your email address.

3.4 User profiles

All Users (Readers and Creators) may update their User Profile, including avatar, display name, bio, and public links. Your profile must comply with our Content & Community Guidelines.

You may delete your Account at any time using the options made available through the Services.

4. Use of the Services

4.1. Permission to use LEMOON

LEMOON grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services in accordance with these Terms.

Readers may use the Services for their personal use. Creators may also use the publishing and monetization features made available by LEMOON, subject to these Terms and, where applicable, the Creator Monetization Terms.

No rights are granted to you except those expressly provided in these Terms.

4.2. Prohibited conduct

You must not use LEMOON in a way that harms the platform, its Users, or third parties.

In particular, you may not:

  • impersonate another person or entity or misrepresent your identity or affiliation;
  • access another person's Account without authorization;
  • use bots, scrapers, crawlers, data-mining tools, or other automated methods to access or extract information from the Services without our authorization;
  • artificially manipulate views, reads, likes, follows, comments, earnings, rankings, recommendations, or other platform activity;
  • interfere with or disrupt the operation, security, servers, or networks of the Services;
  • attempt to bypass security measures, access restrictions, age restrictions, paywalls, or other technical protections;
  • reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services, except to the extent expressly permitted by applicable law;
  • use LEMOON for spam, scams, phishing, fraud, or other deceptive activity;
  • collect personal information about other Users without authorization;
  • use the Services in violation of applicable law, these Terms, or our Content & Community Guidelines.

We may take appropriate action when these rules are violated, as described in Sections 6 and 8.

4.3. Service changes

LEMOON may introduce, modify, update, test, suspend, or discontinue features of the Services as the platform evolves.

We may also temporarily restrict access where necessary for maintenance, security, technical issues, or legal compliance.

Where applicable law requires advance notice or otherwise limits our ability to make a change, we will comply with those requirements.

4.4. Third-party services and advertising

LEMOON may include advertising, sponsored content, promotions, links, or integrations provided by third parties.

Unless expressly stated otherwise, LEMOON does not control or endorse third-party products, services, content, or practices.

Your interactions with third parties are governed by their own terms and policies.

5. Content & Intellectual Property

For this section, “Creator Content” means comics, series, episodes, artwork, stories, characters, covers, and other creative works that a Creator publishes on LEMOON.

Other Content submitted by Users, such as comments, replies, profile information, avatars, and similar community contributions, is referred to as “Other User Content.”

5.1. Your Creator Content belongs to you

LEMOON does not claim ownership of your Creator Content.

Creators retain all copyright and other intellectual property rights they hold in the works they publish on LEMOON.

Publishing on LEMOON is non-exclusive. You remain free to publish, distribute, share, license, sell, monetize, or otherwise use your work anywhere else, including on other platforms, social networks, websites, in print, or through any other channel.

Using LEMOON does not transfer ownership of your Creator Content to us or restrict what you may do with it elsewhere.

5.2. Limited license you grant to LEMOON

To make your Creator Content available through LEMOON, you grant LEMOON a non-exclusive, worldwide, royalty-free license to reproduce, host, store, display, communicate, and make that Content available for the purposes of providing, operating, distributing, displaying, improving, and promoting LEMOON and the Creator Content.

This license allows us, among other things, to:

  • make your Content available through the LEMOON website, applications, Creator Dashboard, and other parts of the Services;
  • display it in feeds, search results, recommendations, collections, profiles, previews, and other discovery features;
  • technically process it where necessary to operate the Services, including formatting, resizing, compressing, transcoding, or creating thumbnails and previews, without making substantive creative changes to your work;
  • use your series title, cover, Creator name or pseudonym, and reasonable excerpts from your Content to feature or promote your work and LEMOON through channels operated by LEMOON, such as our website, applications, social media accounts, newsletters, promotional materials, and app-store pages.

The license is limited to operating, distributing, displaying, discovering, and promoting Creator Content through or in connection with LEMOON.

It does not give LEMOON ownership of your work.

5.3. What this license does not allow

Unless you separately agree otherwise in writing, LEMOON will not:

  • sell ownership of your Creator Content;
  • license your comics or other creative works to publishers, studios, merchandise companies, or other third parties for their independent commercial exploitation;
  • create films, animations, merchandise, print editions, adaptations, sequels, or other derivative creative works based on your Content;
  • prevent you from publishing or monetizing your work elsewhere; or
  • claim ownership of your characters, stories, artwork, or other intellectual property.

If LEMOON wishes to offer you a publishing, adaptation, licensing, merchandising, original-content, or similar opportunity, it will require a separate agreement between you and LEMOON.

5.4. Creator monetization

Creators may be eligible to participate in monetization programs offered by LEMOON.

Participation in those programs is governed by the separate Creator Monetization Terms and, where applicable, additional program-specific conditions.

Nothing in this section itself creates an entitlement to compensation.

5.5. Other User Content

By submitting Other User Content, such as comments, replies, profile information, avatars, or other community contributions, you grant LEMOON a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, communicate, technically process, and otherwise use that Content as reasonably necessary to provide, operate, moderate, improve, and promote the Services.

This includes, for example, displaying comments and replies, showing information on User Profiles, making community interactions available through LEMOON, and processing Content as necessary for features of the Services.

We may allow service providers acting on our behalf to exercise these rights only where necessary to provide or support the Services.

5.6. Access by other Users

Making Content available on LEMOON allows other Users to access and interact with it through the features provided by the Services.

This does not give other Users ownership of your Content or permission to copy, reproduce, redistribute, republish, sell, modify, or commercially exploit it outside LEMOON unless you separately authorize them to do so.

5.7. Your responsibilities

You are responsible for the Content you submit or publish on LEMOON.

You represent that you either own the necessary rights to that Content or have obtained the permissions required to publish it and grant LEMOON the rights described in these Terms.

You must not submit Content that infringes another person's copyright, trademark, privacy, publicity, or other rights.

All Content must also comply with applicable law and our Content & Community Guidelines.

5.8. Responsibility for third-party claims

If your Content, conduct, or violation of these Terms causes LEMOON to face a claim from a third party, you are responsible for the losses, liabilities, and reasonable costs resulting from that claim, including reasonable legal costs.

This includes claims resulting from infringement of intellectual property, privacy, publicity, or other third-party rights.

5.9. Removing Creator Content

You may remove your Creator Content from LEMOON at any time.

When you remove it, the license granted under Section 5.2 ends for future uses of that Content, subject to a reasonable period necessary to remove it from active systems.

We will not use removed Creator Content in new promotional materials.

Promotional materials lawfully created and published while your Content was available on LEMOON may remain in existing posts, publications, archives, or materials where removing them is not reasonably practicable.

Any retention required by applicable law or necessary for the establishment, exercise, or defense of legal claims is unaffected.

5.10. LEMOON Intellectual Property

The Services and all elements created, owned, or licensed by LEMOON are protected by intellectual property and other applicable laws.

This includes, among other things, the LEMOON name and trademarks, logos, software, applications, source code, interfaces, designs, graphics, databases, documentation, features, and other materials forming part of the Services.

Except for the limited right to use the Services under these Terms, no rights in LEMOON's intellectual property are granted or transferred to you.

You may not, without our permission:

  • copy, reproduce, distribute, sell, license, or commercially exploit any part of the Services;
  • use LEMOON's trademarks, logos, branding, or other proprietary materials in a way that suggests endorsement, partnership, or affiliation;
  • remove or alter copyright, trademark, or other proprietary notices;
  • create unauthorized copies, adaptations, or derivative versions of the Services; or
  • use LEMOON's intellectual property to develop, operate, or promote another product or service without our permission.

Nothing in this section affects the rights Creators retain in their Creator Content under this Section 5.

5.11. Separate agreements

Nothing in these Terms prevents you and LEMOON from entering into a separate written agreement concerning particular Content, Programs, partnerships, licensing opportunities, or other projects.

If a separate agreement expressly conflicts with this section, that separate agreement will apply only to the subject matter and Content covered by it.

6. Content Moderation & Enforcement

LEMOON is an open publishing platform. Content made available through the Services must comply with these Terms, applicable law, and our Content & Community Guidelines.

The Content & Community Guidelines contain the detailed rules governing what may and may not be published or shared on LEMOON.

6.1. How moderation works

We may review Content when it is reported, when we become aware of a potential violation, or when review is reasonably necessary to operate or protect the Services.

We may use appropriate tools and review processes to assist with moderation.

LEMOON does not review or approve every piece of Content before it is published.

6.2. Moderation actions

Depending on the nature, severity, and circumstances of a violation, we may:

  • request that Content be corrected or appropriately labelled;
  • apply or modify an age or maturity restriction;
  • limit the visibility or availability of Content;
  • remove Content;
  • restrict access to certain features;
  • restrict monetization where the violation affects eligibility for a monetization program;
  • issue warnings;
  • suspend or terminate an Account in accordance with Section 8.

We may take immediate action where reasonably necessary, including in cases involving illegal Content, serious safety concerns, fraud, security risks, or repeated or serious violations.

6.3. Moderation decisions

Where required by applicable law, we will inform the affected User of the reason for a decision to remove or restrict Content or access to the Services.

We may limit information about an enforcement decision where disclosure is prohibited by law or would create a material security or safety risk.

6.4. Reporting Content

Users and rights holders may report Content they reasonably believe violates applicable law, these Terms, or our Content & Community Guidelines using the reporting tools made available by LEMOON.

Submitting a report does not automatically result in removal. We may review the Content, its context, the information provided, and the applicable rules before deciding whether action is necessary.

7. Digital Purchases, Virtual Items & Access

Certain Content or features on LEMOON may require payment, Virtual Items, or another access method made available through the Services.

The price, access requirement, and applicable conditions are displayed before you complete a transaction.

7.1. Virtual Items

LEMOON may make Virtual Items available through the Services, including Lemoon Coins.

Unless expressly stated otherwise, Virtual Items:

  • may only be used within the Services;
  • have no cash value outside LEMOON;
  • cannot be withdrawn or redeemed for money by Users;
  • cannot be sold or exchanged outside the Services; and
  • cannot be transferred between Users or Accounts unless LEMOON expressly allows it.

Virtual Items are not real-world currency, electronic money, cryptocurrency, or a financial investment.

Obtaining Virtual Items gives you a limited, personal, revocable, and non-transferable right to use them for the purposes made available by LEMOON.

7.2. Purchases

Purchases may be made through the Services using the payment methods made available to you.

Depending on your device, location, or method of purchase, transactions may be processed by LEMOON or by a third-party payment provider.

Before completing a purchase, you will be shown the applicable price and the digital item, Content, or benefit you will receive.

Transactions processed by a third-party provider may also be subject to that provider's billing terms and procedures.

7.3. Using Virtual Items

Virtual Items may be used only for Content, features, or other digital benefits for which LEMOON makes them available.

The number of Virtual Items required for a particular transaction will be displayed before you confirm it.

Once Virtual Items have been used, the transaction is generally final and cannot be reversed, except where required by applicable law or where LEMOON expressly provides otherwise.

7.4. Virtual Items provided without payment

LEMOON may provide certain Virtual Items without requiring payment.

Such Virtual Items may be subject to additional conditions, including expiration dates, eligibility requirements, or restrictions on use. Any material conditions applicable to them will be communicated through the Services.

Virtual Items obtained without payment cannot be redeemed for monetary compensation.

7.5. Creator monetization

Creators may be eligible to participate in monetization programs offered by LEMOON.

Participation in those programs is governed by the separate Creator Monetization Terms and, where applicable, additional program-specific conditions.

Nothing in these Terms guarantees access to monetization, any particular level of earnings, or the continued availability of any monetization program.

7.6. Pricing and access conditions

LEMOON may determine and change the prices, Virtual Item amounts, access requirements, and other conditions applicable to Content or paid features.

The conditions shown to you when you complete a transaction will apply to that transaction.

Changes to pricing or access requirements will not retroactively alter a completed transaction except where permitted or required by applicable law.

7.7. Refunds and purchase issues

Purchases and transactions involving Virtual Items or digital Content are generally final once completed.

Where a transaction is processed by a third-party payment provider, its refund procedures may also apply.

If a technical issue prevents you from receiving a valid purchase or accessing Content you validly obtained, you may contact [email protected]. We may restore access, correct the transaction, recredit Virtual Items, or provide another appropriate remedy depending on the circumstances.

7.8. Fraud, abuse, and errors

LEMOON may review, refuse, cancel, reverse, or correct transactions, Virtual Item balances, or access rights where reasonably necessary to address:

  • fraud or unauthorized transactions;
  • chargebacks or payment disputes;
  • manipulation or abuse of the Services;
  • errors; or
  • legal or regulatory requirements.

We may apply limits to transactions, Virtual Items, or access where necessary to protect LEMOON, the Services, Users, or Creators.

7.9. Changes or discontinuation

LEMOON may modify or discontinue a payment, Virtual Item, or digital-access system.

If a material change or discontinuation affects unused Virtual Items that Users purchased or other existing paid rights, we will provide reasonable notice where appropriate and handle those rights in accordance with applicable law.

8. Suspension & Termination

You may stop using LEMOON or delete your Account at any time.

LEMOON may restrict, suspend, or terminate an Account, or access to all or part of the Services, when necessary to enforce these Terms, protect LEMOON or its community, prevent misuse, or comply with legal obligations.

8.1. When we may take action

We may restrict, suspend, or terminate an Account if we determine that:

  • these Terms, our Content & Community Guidelines, Creator Monetization Terms, applicable Program-specific terms, or other applicable LEMOON rules have been violated;
  • the Account is involved in fraud, manipulation, abuse, spam, unauthorized activity, or attempts to exploit the Services;
  • the User repeatedly or seriously infringes the rights of others;
  • the Account creates a security, safety, legal, or operational risk for LEMOON or other Users;
  • the User attempts to circumvent a previous restriction, suspension, or enforcement action;
  • information provided to LEMOON is materially false or misleading where accurate information is required;
  • continued access could expose LEMOON, its Users, Creators, partners, or service providers to harm or liability; or
  • we are required to take action by law, legal process, or a competent authority.

This list is not exhaustive. We may take other reasonable measures where necessary to protect the integrity and proper operation of the Services.

8.2. Scope of enforcement

An enforcement action does not necessarily affect your entire Account.

Depending on the circumstances, LEMOON may:

  • temporarily restrict access to certain features;
  • restrict publishing, commenting, purchasing, or other Account capabilities;
  • suspend access for a defined or indefinite period;
  • terminate the Account; or
  • prevent the creation or use of additional Accounts intended to circumvent an enforcement action.

Where appropriate, we may choose a more limited measure instead of terminating an Account.

Content-specific actions are governed by Section 6 — Content Moderation & Enforcement.

8.3. Immediate action

LEMOON may take action without prior notice where we consider immediate intervention necessary, including in cases involving serious violations, fraud, security threats, unlawful activity, risk of harm, manipulation of the platform, or attempts to evade enforcement.

In other circumstances, we may provide a warning or an opportunity to resolve the issue before taking further action.

8.4. Effect of suspension or termination

Suspension or termination may result in the loss of access to your Account and to features or benefits associated with it.

The treatment of:

  • Creator Content is governed by Section 5;
  • Virtual Items and paid access is governed by Section 7; and
  • Creator monetization is governed by the Creator Monetization Terms and applicable Program-specific terms.

Suspension or termination does not automatically entitle you to a refund, payment, credit, or other compensation, except where expressly provided by the applicable terms or required by law.

8.5. Circumventing enforcement

If an Account has been suspended or terminated, you may not create, acquire, or use another Account for the purpose of avoiding that restriction.

We may restrict or terminate related Accounts where we reasonably determine that they are being used to circumvent an enforcement action.

8.6. Rights and obligations after termination

Termination does not affect rights, obligations, liabilities, or claims that arose before the termination date.

Any provisions of these Terms that by their nature are intended to remain effective after termination will continue to apply, including provisions concerning intellectual property, outstanding obligations, limitations of liability, responsibility for violations, and dispute resolution.

9. Disclaimers & Limitation of Liability

9.1. No warranties

LEMOON is provided on an “as is” and “as available” basis.

We do not guarantee that the Services will always be available, uninterrupted, secure, error-free, or free from bugs or technical issues. We also do not guarantee that any particular feature, Content, functionality, or part of the Services will remain available indefinitely.

You use the Services at your own risk.

9.2. User Content and third parties

LEMOON provides a platform for independent Users and Creators to publish and interact with Content.

We do not endorse, verify, or guarantee User Content or the statements, opinions, information, products, services, or conduct of Users or third parties.

You are responsible for your interactions with other Users and for deciding whether to rely on Content, links, information, or services made available through LEMOON.

LEMOON is not responsible for the availability, conduct, content, security, or operation of independent third-party services.

9.3. Limitation of liability

LEMOON SAS and its directors, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or unforeseeable losses or damages arising from or relating to LEMOON, these Terms, or the Services.

This includes losses resulting from:

  • your use of or inability to use the Services;
  • interruptions, downtime, errors, bugs, or technical failures;
  • loss, corruption, or deletion of data;
  • unauthorized access to or use of an Account;
  • User Content or the actions of another User or Creator;
  • third-party platforms, payment providers, websites, or services;
  • changes to, restriction of, suspension of, or discontinuation of any part of the Services;
  • moderation or enforcement actions taken under these Terms;
  • loss of profits, revenue, business opportunities, goodwill, or other commercial or economic losses; or
  • circumstances outside LEMOON's reasonable control.

LEMOON is not responsible for any loss or damage that results from your failure to comply with these Terms, protect your Account, follow reasonable security precautions, or use the Services as intended.

9.4. Maximum liability

If LEMOON SAS is found liable for any claim arising from or relating to the Services or these Terms, LEMOON's total aggregate monetary liability for all claims arising from the same or related circumstances will not exceed €100.

The €100 limit applies collectively to all claims arising from the relevant circumstances, regardless of the legal basis or form of the claim.

10. Governing Law & Disputes

These Terms and your relationship with LEMOON are governed by the laws of France.

10.1. Resolving disputes

If you have a dispute with LEMOON, we encourage you to contact us first so that we can attempt to resolve the matter directly.

Before starting formal proceedings, you agree to make a reasonable attempt to resolve the dispute with LEMOON informally.

10.2. Jurisdiction

Any dispute arising from or relating to these Terms or the Services that cannot be resolved informally will be submitted to the competent courts in accordance with applicable law.

Where you are acting in a professional or commercial capacity, the courts of Paris, France will have jurisdiction over disputes relating to these Terms.

Nothing in this section prevents LEMOON from seeking urgent or protective measures where necessary to protect the Services, its intellectual property, its Users, or its legal rights.

10.3. Local requirements

If laws applicable to you provide rights or dispute-resolution procedures that cannot be replaced by these Terms, those requirements will continue to apply.

11. General Provisions

11.1. Entire agreement

These Terms, together with the policies and additional terms expressly incorporated into them, form the agreement between you and LEMOON regarding your use of the Services.

This includes, where applicable:

  • our Content & Community Guidelines;
  • our Creator Monetization Terms;
  • applicable Program-specific terms; and
  • any additional terms that apply to a specific feature, program, or service you choose to use.

If additional terms expressly conflict with these Terms, the additional terms will apply only to the feature, program, or subject matter they govern.

11.2. Severability

If any provision of these Terms is found to be invalid, unenforceable, or ineffective, the remaining provisions will continue to apply.

The affected provision will be interpreted or limited as necessary while preserving its intended purpose as closely as possible.

11.3. No waiver

If LEMOON does not immediately exercise or enforce a right under these Terms, that does not mean we waive that right.

Any waiver must be expressly made by LEMOON and applies only to the specific circumstances for which it is given.

11.4. Assignment

You may not transfer or assign your Account, these Terms, or your rights or obligations under them to another person without LEMOON's permission.

LEMOON may assign or transfer these Terms, in whole or in part, in connection with a reorganization, financing, merger, acquisition, sale of assets, transfer of the Services, or other change involving LEMOON's business.

11.5. Feedback

If you provide feedback, ideas, suggestions, or recommendations relating to LEMOON or the Services, you allow LEMOON to use them without restriction or compensation to you.

Providing feedback does not give you ownership or other rights in LEMOON or in products, features, or services developed using that feedback.

13. Changes to These Terms

LEMOON may update these Terms from time to time to reflect changes to the Services, our policies, our business, or other requirements.

When we make material changes, we may notify you through the Services, by email, or through another appropriate method.

The updated Terms will indicate the date they were last revised and will become effective on the date specified in the updated version.

By continuing to use LEMOON after the updated Terms take effect, you agree to the revised Terms.

If you do not agree with an update, you should stop using the Services and may delete your Account at any time.
